These general conditions of sale are applicable from 01 December 2021. They are exclusively written in French.

Article 1 : Object and scope

These general conditions of sale (GTC) constitute the basis of all commercial relations established between the Aquitaine Business Driver company domiciled at 9 avenue de Técheney – 33370 Artigues-près-Bordeaux and its customers, individuals or professionals.

They concern all the services provided by Aquitaine Business Driver and are applicable in mainland France.

These general conditions of sale are brought to the attention of each customer to enable him to place an order.

The general conditions of sale described below detail the rights and obligations of Aquitaine Business Driver and its client for all the services sold by Aquitaine Business Driver.

Any reservation of a service including the clause “I acknowledge having read and accept the general conditions of sale” implies the customer’s unreserved acceptance of these general conditions of sale.

Article 2 : Order

Any reservation, whatever the means and the medium, constitutes an order. The payment by the customer of the corresponding deposit entails on his part the obligations resulting from the acceptance of an order. Payment of the deposit obliges Aquitaine Business Driver to provide the reserved service.

Article 3 : Price

The price of the services sold are those in effect on the day of the effective reservation of a service.

The Aquitaine Business Driver company conditions any conclusion of a contract on the written acceptance of its quote by the customer. This estimate indicates precisely the proposed price, its object, its basis of calculation (fixed price, hourly, kilometer) as well as the other costs which could require the service.

The prices are denominated in euros and expressed exclusive of tax. Consequently, their invoicing will take into account the VAT rate in force on the day of the reservation.

Aquitaine Business Driver undertakes to invoice its services at the price agreed upon when the deposit is paid. It reserves the right to modify its prices at any other time.

All reservations are effective upon receipt of a deposit.

Article 4 : Price reduction

No price reduction is granted.

Article 5 : Discount

No discount is granted.

Article 6 : Deposit

A deposit representing 50% of the price excluding tax of the service will be requested for any reservation, excluding transfers within the Bordeaux metropolitan area. The latter is limited to the sole perimeter of Bordeaux Métropole.

Article 7 : Terms of payment

Payment of the deposit is made exclusively by credit card and results in the issuance of a receipt sent digitally to the buyer.

Payment of the balance is made to the driver and by credit card on the day of the service.

Payment of the balance of the service gives rise to the issuance of an invoice including VAT sent digitally to the purchaser. The latter can request a paper edition which will be sent to him by post.

Article 8 : Late payment

In the event of total or partial failure to pay for the services provided under the conditions provided for, the buyer must pay Aquitaine Business Driver a late payment penalty equal to three times the legal interest rate.

The legal interest rate used is that in force on the day the service is performed.

This penalty is calculated on the basis of the amount including tax of the amount remaining due and runs from the due date of the price without any prior notice being necessary.

In addition to late payment compensation, any sum remaining due on its eligibility date will automatically result in the payment of a lump sum compensation of 40 euros due for recovery costs.

(Articles 441-10 and D.441-5 of the Commercial Code).

Article 9 : Force majeure

The responsibility of the Aquitaine Business Driver company cannot be implemented in the event of non-performance of the service if it results from a case of force majeure. Force majeure is understood within the meaning of Article 1218 of the Civil Code as “an event which could not be reasonably foreseen when the contract was concluded and the effects of which cannot be avoided by appropriate measures”.

Aquitaine Business Driver must notify its client in writing of the event constituting force majeure within 72 hours of its occurrence.

Article 10 : Cancellation

Any cancellation of a service by a customer must be notified in writing as soon as possible to Aquitaine Business Driver.

Any cancellation notified in writing to Aquitaine Business Driver no later than 48 hours before the performance of the service concerned will be subject to a full refund of the deposit paid for this service.

If, at the time of cancellation, costs and expenses have previously been incurred by Aquitaine Business Driver for the performance of the service, they must be fully reimbursed by the customer. Successful receipt of this reimbursement will result in the refund of the deposit under the conditions provided for in the previous paragraph.

In the absence of cancellation, the full amount of the service will be due.

Article 11 : Liability

The responsibility of the Aquitaine Business Driver company relating to the transport of persons is engaged from the time of getting into the vehicle, during the entire transport and until the descent of the vehicle.

The responsibility of the Aquitaine Business Driver company relating to the transport of luggage is engaged for their loading into the vehicle, their transport and their unloading from the vehicle.

Article 12 : Competent court

Any dispute relating to the interpretation and execution of these general conditions of sale is subject to French law.

In the absence of an amicable resolution, the dispute will fall under the exclusive jurisdiction of the Courts of Bordeaux.
